UK immigration law in relation to UK Education Providers

Under the current immigration laws, education providers are now generally responsible for their students and their obligations have also increased significantly regarding international students.

As a licensed sponsor under Tier 4 of the Points Based System, you are responsible for record keeping, monitoring and reporting to the UK Border Agency (UKBA). Failure to meet these obligations could result in your sponsorship rating being downgraded or withdrawn. To obtain a student visa, prospective students must now have been accepted on a course by a licensed sponsor. Losing your sponsorship license could have serious financial implications, due to the loss of revenue from international students.

In addition to the general sponsorship duties, Institutions must also not assign a confirmation of acceptance for studies (CAS) under Tier 4 unless they are satisfied that the student both intends and is able to follow the course of study concerned.  Please see link about specific duties as a sponsor of student on the UKBA website

With the increase in rigorous and unannounced inspections by the UK Border Agency, it’s more important than ever for UK Education providers to adhere to the rules.
