Visa applications routes are open, but what does that mean for employers?

December 4, 2020

The Home Office has delivered on its promise to bring in the new points-based immigration system before the Brexit transition time runs out.

December 1st marked the first day of Visa applications being accepted for those who want to come to the UK from 1 January 2021 to work under the UK’s new points-based immigration system. Applicants can apply via several routes including:

  • The Skilled Worker route.
  • The Global Talent Visa.
  • The Innovator Visa.
  • Start-up visa.

With the opening of the Skilled worker route, its more important than ever that businesses are ready to benefit from the easier system and seek talent from outside the UK, if they are unable to find their perfect candidate within the UK.

Who can apply for a sponsor License?

To hire eligible employees from outside the UK under the new system, Employers will need to be registered as a licensed sponsor. The application process is straight forward; however, you need not apply if you have unspent criminal convictions for immigration offences, fraud or money laundering, or have had a sponsor license revoked in the last 12 months.

UK Visa and immigration (UKVI) will review your application and supporting documents to ensure you have the appropriate systems in place. They may also visit your premises to make sure you are trustworthy and capable of carrying out your duties.

How do I stay compliant?

Once you have gained your license, your responsibilities continue with ongoing compliance. Checking your foreign workers have the necessary skills, qualifications, or accreditations for the role. Only assigning your certificate of sponsorship to a job that is suitable for sponsoring. And, advising UKVI if your sponsored worker is not complying with the conditions of their visa.

What systems do I need in place?

Having robust HR systems in place is a necessity when applying and maintaining a sponsor license. These are required for monitoring your employees’ immigration status, keeping copies of relevant documents, tracking your foreign workers attendance, and keeping records up to date to name just a few tasks.

Applying for a sponsor license is not a difficult process but understanding all the rules and little idiosyncrasies that UKVI have in place can be baffling. With many years of experience working with UK businesses to apply and keep their Sponsor licenses, MichelleBelle are a trusted company with proven success.
